Human Rights CasesAlmost immediately, transgender Ontarians fought back against the delisting of surgery. In 1999, Michele Josef challenged the constitutionality of delisting surgery, claiming it was discriminatory towards transgender people and outside the powers of the government. Likewise, Martine Stonehouse launched a Human Rights complaint against the provincial government in 2000. These cases continued to be fought in court until surgery was relisted under OHIP in 2008.
